1. Agreement to Terms
By accessing or using CallForge at trycallforge.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including contractors who subscribe to the platform ("Subscribers") and any individuals whose data is processed through the platform.
2. Description of Service
CallForge is a software-as-a-service platform that helps home service contractors collect Google reviews, respond to leads automatically via SMS and email, track local search rankings, and generate social media content from customer reviews. The Service integrates with third-party providers including Twilio (SMS), SendGrid (email), Stripe (payments), and Google Maps Platform (ranking data).
3. Eligibility and Account Registration
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account.
4. Subscription and Payment
CallForge offers paid subscription plans billed monthly. Pricing is displayed on our Pricing page and may change with 30 days' notice to existing subscribers.
All payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
Subscriptions automatically renew each month. You may cancel at any time from your Billing page. Cancellation takes effect at the end of the current billing period — you will retain access until then and will not be charged again.
We do not offer refunds for partial months. If you believe you were charged in error, contact us within 30 days at [email protected].
5. Your Responsibilities and Acceptable Use
By using CallForge, you agree that you will:
- Only upload customer phone numbers and email addresses for individuals who have consented to receive communications from your business
- Comply with all applicable laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state laws governing SMS and email marketing
- Not use the platform to send spam, unsolicited messages, or communications that violate any law
- Not attempt to reverse-engineer, scrape, or interfere with the platform's infrastructure
- Not use the platform for any unlawful purpose or in any way that could harm CallForge or its users
- Ensure all information you provide about your business is accurate and not misleading
You are solely responsible for ensuring you have proper consent before sending any SMS or email through the platform. CallForge is not liable for any TCPA violations, fines, or legal claims arising from your use of the messaging features.
6. SMS Messaging Compliance
CallForge sends SMS messages on your behalf using Twilio. By using the SMS features, you represent that you have obtained express written consent from each recipient to receive text messages from your business. You agree to honor all opt-out requests (STOP replies) promptly. Failure to comply with SMS regulations is your sole responsibility and may result in immediate termination of your account.
7. Intellectual Property
The CallForge platform, including its design, code, features, and branding, is owned by CallForge and protected by applicable intellectual property laws. You retain ownership of all data you upload to the platform, including customer lists and business information. You grant CallForge a limited license to process that data solely for the purpose of providing the Service.
8. AI-Generated Content
CallForge uses artificial intelligence to generate lead response messages and social media captions. You are responsible for reviewing AI-generated content before sending or publishing it. CallForge does not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content. You agree not to hold CallForge liable for any consequences arising from AI-generated messages sent through the platform.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. CallForge does not warrant that the Service will be uninterrupted, error-free, or that any specific results will be achieved, including improvements in Google rankings, review counts, or lead conversion rates. Ranking data provided by the rank tracker is sourced from Google Maps Platform and may not reflect real-time search results.
10. Limitation of Liability
To the maximum extent permitted by law, CallForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to CallForge in the 3 months preceding the claim.
11. Termination
You may cancel your account at any time from the Billing page. CallForge reserves the right to suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or use the platform in a way that could harm other users or third parties. Upon termination, your access to the platform will cease and your data will be deleted within 30 days.
12. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
